Indoor Range Simulator Safety & Liability Waiver

ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND SAFETY AGREEMENT

1. Acknowledgment of Activity

I understand that Armogan Consulting & Training LLC (“Armogan”) operates an indoor firearms training simulator utilizing realistic replica firearms, laser-based training systems, competitive shooting scenarios, tactical exercises, and related activities (collectively referred to as the “Simulator Activities”).

I understand that these activities may involve:

Physical movement and exertion
Exposure to flashing lights, loud noises, stress-inducing scenarios, or simulated tactical situations
Handling realistic training weapons or replica firearms
Competitive events or timed drills
Interaction with other participants and instructors

I understand that although no live ammunition is used in the simulator area, the activities still require strict adherence to all safety procedures.

2. Assumption of Risk

I voluntarily choose to participate in Simulator Activities and fully understand that participation involves inherent risks, including but not limited to:

Slips, trips, or falls
Physical injury
Emotional stress or anxiety
Negligent acts of other participants
Equipment malfunction
Accidental contact with training equipment
Aggravation of pre-existing medical conditions

I knowingly and voluntarily assume all risks associated with participation, whether known or unknown.

3. Participant Safety Rules

I agree to comply with all posted rules, verbal instructions, and safety procedures established by Armogan staff and instructors, including but not limited to:

Treat all training weapons as if they are real firearms
Never intentionally point any simulator firearm at a person unless instructed during a training exercise
Keep fingers off triggers unless actively participating in a drill
No horseplay, reckless conduct, or unsafe handling
No live firearms, ammunition, knives, or weapons in designated simulator areas unless specifically authorized
Immediately report unsafe conditions or injuries to staff

I understand that failure to follow safety rules may result in immediate removal from the premises without refund.

4. Medical Acknowledgment

I certify that I am physically and mentally capable of participating in Simulator Activities. I understand that some activities may elevate stress levels, increase heart rate, or involve physical movement.

I agree that participation is voluntary and at my own risk.

5. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Armogan Consulting & Training LLC, its owners, officers, employees, instructors, volunteers, contractors, affiliates, landlords, sponsors, and event partners from any and all claims, liabilities, damages, injuries, losses, demands, actions, or causes of action arising out of or related to my participation in Simulator Activities, including claims arising from ordinary negligence.

This release applies to:

Personal injury
Property damage
Emotional distress
Illness
Death
Economic loss

6. Indemnification

I agree to indemnify and hold harmless Armogan Consulting & Training LLC from any claims, damages, costs, or attorney’s fees arising from:

My actions or conduct
My violation of safety procedures
Damage caused by me to equipment or property
Injury caused by my negligence or misconduct

7. Emergency Medical Treatment

I authorize Armogan staff to seek emergency medical treatment on my behalf if necessary. I understand that I am solely responsible for any resulting medical costs.

8. Right to Refuse Participation

Armogan reserves the right to deny or terminate participation to any person for unsafe behavior, suspected intoxication, disruptive conduct, or failure to comply with instructions.

9. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of North Carolina.

If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

10. Acknowledgment of Understanding

I acknowledge that:

I have carefully read this Agreement
I understand its contents
I understand that I am waiving certain legal rights
I sign this Agreement voluntarily and without coercion
